Such consent constitutes prior express consent, and where required by applicable law, prior express written consent, to receive SMS Communications, including messages sent using automated technology. SMS Communications may include, without limitation, account notifications, onboarding communications, service-related updates, administrative messages, and, where permitted by applicable law and consistent with User consent, marketing or promotional communications relating solely to Great Blue IQ's services, programs, or opportunities. Message frequency may vary based on the User's interaction with the Services and account activity.

4.2 User Representations and Warranties

Users represent and warrant that any mobile telephone number provided to Great Blue IQ is accurate, current, and belongs to the User, or that the User has full legal authority to provide such number and to consent to receive SMS Communications at such number. Users acknowledge and agree that they are solely responsible for ensuring that any mobile telephone number provided remains accurate and associated with the User, and that Great Blue IQ has no obligation to verify the identity of any recipient of SMS Communications. Users expressly assume all risks associated with reassigned, recycled, or incorrect telephone numbers and agree that Great Blue IQ shall have no liability for communications sent to any such number.

4.3 Opting Out of SMS Communications

Users may opt out of SMS Communications at any time by replying "STOP" to any message received. Upon receipt of a valid opt-out request, Great Blue IQ will process the request within a commercially reasonable timeframe and will cease sending SMS Communications to that number, except to the extent a limited confirmation message is permitted or required by applicable law. Great Blue IQ uses information collected in connection with SMS Communications solely for purposes of administering, delivering, documenting, and supporting such communications and managing User communication preferences in connection with the Services.

Great Blue IQ does not sell, rent, or share mobile telephone numbers or SMS consent data with third parties or affiliates for their independent marketing or promotional purposes. All categories of personal information described in this Privacy Policy expressly exclude SMS opt-in data and consent records from any form of third-party sharing for purposes unrelated to the provision of SMS Communications.
